1. Introduction

This website, secondactstrategy.org (Website), is operated by Second Act Strategy (ABN 46 203 535 870) (“we”, “us”, “our”). These Legal Terms govern your use of our Website and the purchase or use of any products, services, coaching, programs or resources provided by Second Act Strategy.

By accessing this Website, purchasing services, or using any materials provided by Second Act Strategy, you agree to comply with these Terms. If you do not agree with these Terms, you must not use this Website.

 

2. Website Use

You agree to use this Website only for lawful purposes. You must not:
• attempt to gain unauthorised access to any part of the Website
• interfere with Website security or functionality
• scrape, copy or reproduce Website content without permission
• distribute malware or harmful software
• use the Website in any way that may damage our reputation or services.

3. Nature of Services

Services provided by Second Act Strategy include coaching, mentoring, educational resources, strategies and digital products. These services are provided for informational and educational purposes only and do not constitute financial, legal, investment, or professional advice.

 

You are responsible for your own decisions and outcomes when applying information or strategies obtained through our services.

4. Independent Decision and No Reliance

You acknowledge that any decisions you make based on information, strategies, coaching or materials provided by Second Act Strategy are made independently by you.

Second Act Strategy does not provide financial, legal, investment or professional advice and does not accept responsibility for any decisions, actions or results arising from the use of our services or materials.

You agree that you are solely responsible for evaluating the suitability of any information, strategies or recommendations provided and for any outcomes resulting from their implementation.

5. Fees and Payment

All fees are listed on the Website and may change from time to time. Payments must be completed via approved payment methods including Stripe, PayPal or bank transfer. Payment plans may be offered at our discretion. Where a payment plan is approved, payments will be automatically charged according to the agreed schedule.

If a payment plan is entered into, you remain responsible for completing all payments regardless of whether you continue to access the services.

6. Late Payments

Payments overdue by more than five business days may incur interest at a rate of 10% per annum (calculated daily) on the outstanding amount. We may also recover reasonable debt collection costs.

7. Refund Policy

Refunds are not available for change of mind. Digital products, coaching services and program access are generally non-refundable once delivered or accessed.

Nothing in these Terms excludes your rights under the Australian Consumer Law. If a refund is approved for any reason, administrative fees may apply. If a payment plan refund is approved, an administrative fee of $100 USD may be deducted from the refund amount. Access to digital materials constitutes delivery of the product

  • Digital Product Delivery: All digital products, courses, templates, and downloadable materials are delivered electronically via email or through a secure online platform. By purchasing a digital product, you acknowledge that delivery occurs immediately upon access being granted. Failure to download or access materials after purchase does not constitute non-delivery. If you experience technical issues accessing purchased materials, you must contact us at hello@secondactstrategy.org so we can assist.

  • Payment Plan Obligations: Where a payment plan is selected, you agree to complete all scheduled payments regardless of whether you continue to use or access the services, programs or materials. Failure to complete payments may result in suspension of access and recovery of the outstanding balance.

  • Chargebacks and Payment Disputes: You agree not to initiate any chargeback or payment dispute with your payment provider without first contacting Second Act Strategy to attempt to resolve the issue. Where a chargeback is initiated without prior contact, we reserve the right to:

    • suspend access to services or programs

    • provide evidence of agreement to these Terms to the payment processor

    • recover any outstanding amounts owed.

8. Program Access

Access to programs, digital materials or services may be suspended or terminated if these Terms are breached, including non-payment or unauthorised sharing of materials.

9. Intellectual Property

All materials, content, resources, templates, recordings, videos, course materials and strategies provided by Second Act Strategy are the intellectual property of Second Act Strategy and are protected by copyright, trademark and other intellectual property laws.

 

Purchase of any product or service grants you a limited, non-exclusive, non-transferable licence for personal use only.

 

You may not copy, reproduce, republish, upload, post, transmit, translate, sell, distribute, or create derivative works from any materials provided without prior written permission from Second Act Strategy.

 

Access to any program or digital platform is granted to a single user only. Login credentials must not be shared with any other person. Unauthorised sharing, reproduction, distribution, or resale of program materials is strictly prohibited.

 

If we reasonably believe unauthorised sharing or distribution has occurred, we reserve the right to suspend or terminate access to the program without refund.

10. Confidentiality

We take reasonable steps to maintain confidentiality of information shared during coaching or consulting sessions. However, confidentiality cannot be guaranteed where disclosure is required by law or necessary to deliver services.

11. Earnings Disclaimer

Second Act Strategy makes no guarantees regarding financial outcomes, business success, or earnings. Any examples of results or income are illustrative only and are not promises or guarantees of future performance. Results will vary depending on individual effort, experience, market conditions and other factors.

12. Limitation of Liability

To the maximum extent permitted by law, Second Act Strategy excludes all liability for any loss or damage arising from use of the Website, services or materials.

Nothing in these Terms excludes rights under the Australian Consumer Law. Where liability cannot be excluded, our liability is limited to resupplying the services or refunding the amount paid for the services.

13. Force Majeure

We are not responsible for failure or delay in delivering services due to circumstances beyond our reasonable control, including natural disasters, technical failures, government actions or infrastructure outages.

14. Dispute Resolution

If a dispute arises, both parties agree to attempt resolution through good faith negotiation. If the dispute cannot be resolved, either party may refer the matter to mediation through the Dispute Settlement Centre of Victoria before commencing litigation.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

16. Privacy Policy

We are committed to protecting your privacy and handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

We may collect personal information including name, email address, phone number, mailing address, and information related to purchases or enquiries. Payment information is processed securely by third-party payment providers and is not stored by us. Personal information may be used to provide services, process purchases, communicate with you, improve the Website, and send marketing communications where consent has been provided.
